Attorney Randall Chiera Wins $1,650,000 for His Client in Surgical Malpractice Case

This case concerned surgical malpractice where it was alleged a knee implant was improperly placed in the Plaintiff. It was argued that the implant used by the doctor was the wrong size for the patient, resulting in significant and debilitating chronic pain and swelling when walking and standing. As a result of this negligence, Plaintiff underwent a second surgery performed by subsequent treating orthopedic surgeon where the initial implant was removed and a new knee implant was surgically implanted.

Although it was asserted the second implant was the medically correct size for the Plaintiff, the damaged caused by the initial improper implant resulted in continued pain and suffering post surgery. Defendant Doctor refused to settle this case and as a result the case was tried to verdict. After Mr. Chiera’s compelling closing arguments to the jury, and after 2 days of deliberation, the jury found that the Defendant was negligent and awarded the Plaintiff $1,650,000.
